Refund Policy
1. Introduction
Welcome to Brand Mindz Global Technology Pvt Ltd (“Company”, “we”, “our”, or “us”). We provide professional B2B services including website development, application development, digital marketing, SEO, performance marketing, social media management, personal branding, and business consulting services in India.
This Refund & Cancellation Policy outlines the terms governing refunds, cancellations, and payment disputes. By engaging our services, making payments, or approving proposals, the client agrees to this policy in full.
2. No Refund After Project Commencement
Once a project has commenced, no refunds shall be issued under any circumstances.
Project commencement includes, but is not limited to:
- Requirement analysis and strategy planning
- Design, wireframes, or mockups
- Account setup (Ads, Analytics, SEO tools, etc.)
- Allocation of internal resources
- Any billable work initiated by the Company
This policy exists due to irreversible allocation of time, expertise, manpower, and operational costs.
3. Cancellation Before Project Commencement
If a cancellation request is submitted before any work has commenced, a refund may be issued after deducting:
- Administrative charges
- Payment gateway or transaction fees
Approved refunds will be processed within 7–10 working days from the date of approval.
4. Advance Payments & Non-Refundable Fees
All advance payments, onboarding fees, consultation fees, or booking amounts are non-refundable once the project is initiated, unless otherwise stated explicitly in a written agreement signed by both parties.
5. Milestone-Based Projects
For milestone-based engagements:
- Payments made for completed or active milestones are non-refundable
- Refunds, if considered, may apply only to uninitiated milestones
Any refund decision shall remain at the sole discretion of the Company.
6. Unsatisfactory Performance
If the client is dissatisfied with the progress or deliverables:
- Concerns must be communicated in writing with specific details
- The Company will make reasonable efforts to rectify issues within the agreed scope
Refunds are not guaranteed and will be evaluated on a case-by-case basis. Dissatisfaction alone does not entitle the client to a refund.
7. No Guarantee of Results
The Company does not guarantee specific outcomes, including but not limited to:
- SEO rankings
- Website traffic
- Lead volume
- Revenue growth
- Conversion rates
- Ad performance or ROAS
Digital marketing and technology outcomes depend on external factors such as market conditions, competition, platform algorithms, client cooperation, and third-party tools.
8. Change in Scope
Any change in scope, objectives, features, or deliverables after project commencement:
- Will not be eligible for refunds
- May require revised timelines and additional costs
- Must be approved in writing by both parties
9. Delays Due to Client
Refunds shall not apply if project delays occur due to:
- Delayed content, approvals, or inputs from the client
- Lack of communication or feedback
- Client-initiated pauses or revisions
10. Third-Party Services & Tools
Payments made for third-party services including (but not limited to):
- Domains and hosting
- Paid plugins or software licenses
- Advertising platforms (Google, Meta, etc.)
- SEO or analytics tools
are strictly non-refundable under any circumstances.
11. Chargebacks & Payment Disputes
Clients agree not to initiate chargebacks or payment disputes without first contacting the Company for resolution.
Any chargeback initiated after service commencement shall be treated as a breach of contract, and the Company reserves the right to suspend services and take necessary action.
12. Service Suspension or Termination
The Company reserves the right to suspend or terminate services without refunds in cases of:
- Non-payment or delayed payments
- Policy violations
- Misuse of services
- Breach of agreement or abusive conduct
13. Force Majeure
The Company shall not be held liable for delays or non-performance caused by events beyond reasonable control, including natural disasters, government actions, technical failures, or platform outages.
14. Governing Law & Jurisdiction
This policy shall be governed by and interpreted in accordance with the laws of India. Any disputes shall fall under the exclusive jurisdiction of the courts of Chennai, Tamil Nadu.
15. Acceptance of Policy
By making a payment, approving a proposal, signing an agreement, or engaging our services, the client acknowledges and agrees to this Refund & Cancellation Policy.
